Texas Court of Appeals Affirms Trial Verdict in Favor of Client

The Texas Court of Appeals in Houston has affirmed a trial verdict in favor of Firm client DynCorp International, LLC in a lawsuit alleging breach of contract related to deployed security forces in Iraq. At trial, the Plaintiff argued that DynCorp improperly withheld funds to be paid to deployed forces, and that the decision to withhold the funds violated the contract between the parties. DynCorp defended the merits of the case on the specific requirements set forth by the US State Department for deployed private security forces in Iraq, and plaintiff did not meet the State Department requirements. Cody Towns served as lead trial counsel for DynCorp as well as lead counsel on appeal. The trial court entered verdict in favor of DynCorp. The case is Sweeney v. DynCorp International, LLC, No. 14-08-00923-CV (Tex. Civ. App. - Houston [14th Dist] Mar. 11, 2010).
