Judge Issues Defense Judgment in Favor of Client on the Day Before Jury Trial Begins

Dallas County District Judge Carl Ginsberg ruled Monday that the claims brought by Plaintiff, Charles Beesley, against Defendants Hydrocarbon Separation and its president, Gary McPeak, were not supported by law or facts sufficient to go forward to trial.  The hearing and decision on Defendants' Motion for Summary Judgment came just one day before the case was to proceed to jury trial in a Dallas courtroom.

The judgment brings to an end bitter litigation lasting more than two years over the asset purchase of intellectual property of a secret formula marketed as a cleaning agent.  Plaintiff alleged that pursuant to an agreement with Defendants, he was owed in excess of $500,000 for the formula as well as ongoing payments as a consultant.  Defendants denied the allegations and further argued that Beesley delayed raising his cause of action beyond the statute of limitations, and was therefore barred from recovery.

The court agreed with Defendants and entered final judgment against Beesley on all claims.

Cody Towns was hired as lead trial counsel for Defendants to replace their prior attorneys just three months before trial was scheduled to begin.
