Jury Rejects $4 Million Claims Against Clients in Conspiracy and Trade Secrets Trial

A jury in Dallas County issued a verdict Wednesday in a highly contentious case brought by Brinson Benefits, Inc. against Holmes Murphy & Associates, one of its employees and a former Brinson employee. Brinson Benefits alleged that Holmes Murphy & Associates conspired to upload trade secret and customer information to deliver to Holmes Murphy & Associates for the purpose of interfering with Brinson's business contracts with clients.  Brinson asserted violations of the Texas Theft Liability Act, conspiracy to breach non-compete and non-solicitation agreements and other state laws.  Brinson sought as much as $4 million in damages.

At the conclusion of the lengthy trial, Dallas District Court Judge Martin Lowy dismissed the claims against Holmes Murphy & Associates and the jury found in favor of all remaining claims against the Holmes Murphy & Associates' employee.  Under the Texas Theft Liability Act, Holmes Murphy & Associates is entitled to recover the legal fees expended in defending the case.
